Terms and Conditions for Training Courses

1.  Registration and Course confirmation

 

All registrations and course confirmation are processed by AviaQuality administration:

a) By registering, normally via the online application booking form, the customer confirms that he/she will attend the AviaQuality course (subject to availability).

 

b) Confirmation of the course will be sent electronically by e-mail to the customer within three (3) working days after the registration together with the related invoice.

 

c) Issuance of confirmation constitutes a binding contract.

2.  Course fee

 

All fees on the AviaQuality website are current at the time of publishing for each Training Course. AviaQuality reserves the right to change them. The course fee will be confirmed in writing by AviaQuality in accordance with clause 1 (b) and 1 (c) above (Registration and Course confirmation) is binding.

 

3.  Payment of Course Fees & AviaQuality’s Rights

 

a) Payment is due within 14 days after the written confirmation of the course (Ref. Par. 1 (b)). This timeline is normally applicable until 30 days (30th day included) prior the training commencement.

 

b) Should the booking take place after 30 days prior the course commencement, the payment will be due no later than 20 days (20th day included) prior the training commencement.

c) In case of late bookings after the 20 days prior the training commencement, AviaQuality retains the right to accept with reserve the booking, based also on seats availability, and agree with the trainee the payment and cancellation times.

 

AviaQuality reserves the right to cancel the reserved seat or give it to another participant and therefore to not allow admission to the training course and facilities at the commencement of the training, if fees are not paid within the times as defined in clauses 3(a), 3(b) and 3 (c) as above mentioned.

As Swiss company, our invoices are issued in swiss francs CHF. For payment in other currencies, the exchange rate on the invoice date applies. The full course instructions are typically sent out three weeks prior to the course start date.

4. Services included in the course fees

 

For public training courses planned by AviaQuality the fees cover course materials, refreshments during the training (e.g., coffee break, snacks, beverages), buffet lunch, examination (when required) and evidence of qualification (certificate) upon successful completion or a certificate of attendance and exclude all other meals, accommodation and transportation.

 

For in-house training courses the fees cover the instructor, course materials, examination and evidence of qualification (certificate) upon successful completion or a certificate of attendance and exclude training facilities (e.g., training room and equipment), meals, refreshments, accommodation and transportation unless otherwise stated. Costs for any consumptions (meals or other services) at the venue outside the services included in the event, as per this Terms and Conditions, will not be covered by AviaQuality and shall be paid directly by the participants.

5. In-house trainings

​

In-house training courses shall be scheduled at least six weeks prior to the beginning of the training course.

 

The quote will be subject to trainer’s availability for the desired dates. Should in house trainings be required to be conducted during weekends or during Swiss Federal Holidays, a 50% surcharge will be included.

 

The customer shall provide AviaQuality with assistance and facilities as reasonably required for the execution of the training event. The customer shall furthermore ensure that, as a minimum requirement, the training facilities are kept at a comfortable temperature, have sufficient lighting and ventilation and are equipped with: ï‚·

  • Marker board or flip charts and writing implements ï‚·

  • Projector and screen ï‚·

  • Classroom or teaching space with desks/writing surfaces ï‚·

  • Adequate toilet facilities ï‚·

  • Internet access (Preferably WIFI) at the facilities during the training

​

6. Course material

 

AviaQuality will provide the training course material in English for its training courses. Training material for public and in-house courses will be provided either as hardcopy or in electronic format.

 

7. Course Language

 

The courses are delivered in English. Italian language is also available on request.

 

8. Number of Participants

 

Open courses are limited to 10 participants. AviaQuality reserves the rights to cancel the course should the number of participants be less than 3.

 

9. Course Certificate

​

Upon completion of the course, the participant will receive either a "Certificate of Attendance" or a "certificate of Completion".

The certificate will be issued upon receipt of the payment and the participant attended at least 90% of the course.

10. Customer Cancellation

 

The following payment conditions are applicable for cancellation:

 

Open courses:

 

0-7 calendar days prior to course:

      100 % will be charged

8-19 calendar days prior to course:

     50% will be charged

20 or more calendar days prior course beginning:

    No charge

 

In-House trainings:

 

0-7 work days prior course beginning:

      Cancellation fee 100% of the course fee plus possible travel and accommodating expenses

 

10.  Cancellation due Coronavirus or similar global pandemics

 

Should an event participant/traveller be unable to attend the booked event date due to official travel/entry bans or quarantine orders (including upon return from the booked destination country) due to coronavirus or similar global pandemics according to the definition of the WHO, their training seat may be cancelled free of charge or voucher may be offered (upon customer’s choice), provided that it has been proven by the guest that it is objectively impossible for the event participant/traveller to travel/enter the country for the aforementioned reasons.

 

Concerns on the part of the guest or official recommendations to refrain from travel or events do not constitute a right of withdrawal free of charge

11.  Participant Resignation

 

No reimbursement (full or partial) will be provided if a participant withdraws from the course after its start.

 

12. Participants Replacement

 

Replacement of participants are allowed at any time prior the commencement of the course. Immediate notification to AviaQuality with personal details is however required.

13. Cancellation by AviaQuality

 

If a course is cancelled or rescheduled for any unforeseen reasons (e.g. illness of the instructor, minimum number of participants not reached etc.), event of force majeure (e.g. coronavirus or other pandemics) , or due to legal or official requirements (e.g. in the form of regulations, general rulings or administrative acts) an alternate date will be arranged. If a participant is not able to take part on the new date, a voucher or refund (upon customer’s choice) will be made of the paid fees.

In case of a cancellation, AviaQuality will notify the Client in writing (e-mail or by other means) or by phone. AviaQuality will not be liable for any claims of compensation for travel, hotel, etc.

 

14. Venue

​

AviaQuality does not accept any responsibility for the loss of or damage to personal property at the venue unless caused by willful misconduct or gross negligence on the part of AviaQuality staff or its contractors/subcontractors.

 

Any damage to or in the venue building that may be caused by the event participant(s) is responsibility solely of the participant(s) causing the damage.

 

Participants are not allowed to bring food and drink into the events. Personal belongings and material that are brought in the venue shall be removed from the venue at the end of each training day. Participants are not allowed to handle the technical equipment used for the training.

 

15. Copyright/Intellectual Property

​

The training material is protected by copyright in which AviaQuality has explicit rights. Its use is allowed for internal use only.

AviaQuality makes every endeavor to ensure the accuracy of its training content but it does not accept liability for any errors or omissions.  AviaQuality is not liable for any damages originated by any non compliance of the customer towards its applicable regulations.

​

The AviaQuality company logo is a registered trademark. The brand names and specific services of AviaQuality featured on the website are trademarked. Prior to the use of AviaQuality's  name, brand or logo in any publication or official statement, formal written permission from AviaQuality is required.

16. Exclusions and Limitations of Liability


AviaQuality, its personnel and its subcontractors shall not be liable for any direct or indirect damage to, or loss of property, injury to or death of or any other damage sustained by the customer, its personnel, agents or third parties, due to or in connection with or as a consequence of the performance or non-performance of work under these Standard Terms and Conditions, unless caused by willful misconduct or gross negligence of AviaQuality personnel and the customer shall indemnify and hold harmless AviaQuality, its personnel and its subcontractors against any and all such claims, including costs and expenses incidental thereto.

In any case AviaQuality will not be liable for any consequential damages and its liability under this Agreement shall be limited to the amount received by AviaQuality for services already performed in the course of the service as at the time the damage occurred.

17. Changes to the training course

 

We reserve the rights to adjust course fees, content as well as performance dates and locations.

 

18. Place of Jurisdiction

 

Kloten in Canton Zurich, Switzerland, is the place of business and therefore AviaQuality falls under Zurich Canton’s legal jurisdiction.

19. Privacy Policy

 

The participants agree to provide AviaQuality for the only purpose to perform the contracted service, all necessary information (for example Billing data and record) as described in the General Policy Privacy of AviaQuality published in AviaQuality’s website.

 

20.  Communication

 

Contact AviaQuality (contact details available at Par. 1 of this document) for any information concerning course confirmation, invoices, etc.
